Very few people know or understand that Justice Kennedy was put into the Supreme Court during the last year of President Reagan's term as President. But when Obama tried to do the same exact thing as part of his Constitutional duty, Republicans claimed he was a tyrant and could not do that. They got away with that nonsensical stealing of a Supreme Court seat, well, just because no one rose up and said NO! Why is the mass media not pointing this unconstitutional  illegal move out? How and when does an extremist minority grab power and dictate plus force their way onto the majority?

Justice Kennedy's rulings must be voided, including the one that put President Bush into office in the Bush/Gore drama in Florida, where a recount was voided and the Conservative Supreme Court handed Bush the victory. The Constitutional way to do this would be to allow the recount and than allow Gore the victory. Why is the mass media not pointing this unconstitutional  illegal power grab out? President Bush installed two more Conservatives, Roberts and Alito, so they also must be removed and their decisions voided, which makes the Supreme Court into a legal and following the Constitution liberal majority.

In a democracy, the majority vote wins. Since Trump won the Electoral College but was in a minority according to the vote count total, basically the election was stolen from the majority and given to the minority. Now Trump is filling two Supreme court seats which do not belong to that minority, and with no agreement from the majority, because McConnell changed the 'rules' of how to pick a Justice, just to force in a couple of really extreme right wing guys. Along with installing a President who should have lost, the Republicans changed the rules to allow seating a judge with only 50 votes instead of the former 60 votes, which allows them to force in a much more extreme judge via a MINORITY. Kavanaugh would not even have a prayer of getting in under the more 'conservative' rules that have existed for a LONG TIME, which Republicans loved under President Obama, when it worked in their favor. But now, when those same rules hinder their chosen extremist favorite, they just change the rules, so they can 'win'.

The mass media and politicians keep on saying that only ONE woman has come forward with credible allegations of sexual assault and/or rape around Kavanaugh. But the REAL number of women who have come forward is much higher.

Why won't the mass media or Republicans report IN DEPTH on the multiple women who have come forward?

Ideally, this judge would not be part of some special club or political party where favors are owed, which have nothing to do with equality, freedom, democracy, the law or justice.

McCain’s bill became law but torture continues.

Most disturbing of all—this is a high bar given the above—Kavanaugh is a fervent devotee to the weird counterconstitutional “doctrine of the unitary executive” promoted by such fellow neocons as Dick Cheney and Paul Wolfowitz. “In its most extreme form, unitary executive theory can mean that neither Congress nor the federal courts can tell the President what to do or how to do it, particularly regarding national security matters,” explained Watergate alum John Dean.

At the time of this writing, composed in the eighth hour of the grotesque historic activity happening in the Capitol Hill chamber, it should be as plain as day that what we witnessed was the patriarchy testing how far its politics of resentment can go. Gee, how does that work, when the first credible accounts of sexual assault happened so many years ago, according to multiple witnesses, none of whom were allowed to testify? Why was only one woman out of the five our six allowed to testify? Why was only ONE woman out of five our six heard from? Why were no witnesses allowed to testify on those women's behalf? If truth is the goal, why not allow all sides to testify and then see where things stand?

Trauma, PTSD, shame, grief, fear and guilt cause sexual abuse survivors to not come forward, ever. It may take 10, 20 or 30 years for a survivor to feel ready to say something in public about the traumatic event. If you have been sexually abused, raped or assaulted, you know this already. But if you have not been a victim, at least get to know the dynamics of how and why this happens, and have some empathy for the victims. Don't immediately start blaming, shaming and attacking the victims. At least hear them out, with an open mind and heart.

Supreme Court nominee Brett Kavanaugh has a big problem with serial lying in his sworn testimony to the Senate Judiciary Committee. About really serious stuff, like torture, like warrantless surveillance. Now, Sen. Dianne Feinstein (D-CA) tells Politico, she’s identified another critical lie, in which Kavanaugh lied to senators about having violated secrecy laws governing grand juries during the Starr investigation of President Bill Clinton.

“According to a memo from the National Archives, Brett Kavanaugh instructed Hickman Ewing, a colleague and deputy counsel in the Starr investigation, to ‘call [Chris] Ruddy’ about matters before a grand jury, which would be illegal to disclose,” Feinstein said in a statement to POLITICO. “I asked Judge Kavanaugh in questions for the record whether he had shared ‘information learned through grand jury proceedings.’ His answer, which says that he acted ‘consistent with the law,’ conflicts with the official memo from Mr. Ewing. Disclosing grand jury information is against the law and would be troubling for any lawyer, especially one applying for a promotion to the highest court in the country.”

WHAT KIND OF ETHICS AND MORALS DOES KAVANAUGH HAVE, AFTER HE HAS LIED REPEATEDLY UNDER OATH, AND CONTINUES TO LIE TODAY? 

Judges should not be in office if they are caught lying, because they are the symbols of truth and justice. A judge who lies under oath cannot be trusted with the truth that they are supposed to pursue and find in court cases, where often one side or the other is lying. Kavanaugh denies the allegations, but a credible accuser, Christine Blasey Ford, described them in riveting testimony before the Senate Judiciary Committee on Thursday.

If Flake sticks by his demand, it may mean the GOP wouldn’t have the votes to confirm Kavanaugh. With such a razor-thin margin, Republican leadership agreed to allow a week for a new background check Friday afternoon.

Lying, or making a false statement, is a federal crime under a number of circumstances. Perjury is a false statement made under oath before a federal tribunal or official. Moreover, some false certifications are punishable as perjury by operation of a federal statute. Subornation of perjury is inducing someone else to commit perjury. It, too, is a federal crime if the perjury induced is a federal crime. Finally, conspiracy to commit any these underlying crimes is also a separate federal crime.5 Moreover, a defendant under investigation or on trial for some other federal offense may find upon conviction his sentence for the underlying offense enhanced as a consequence of a false statement he made during the course of the investigation or trial. This is an overview of federal law relating to the principal false statement and to the three primary perjury statutes.

False Statements (18 U.S.C. § 1001)

The principal federal false statement statute, 18 U.S.C. § 1001, proscribes false statements, concealment, or false documentation in any matter within the jurisdiction of any of the three branches of the federal government.6It applies generally within the executive branch. Within the judicial branch, it applies to all but presentations to the court by parties or their attorneys in judicial proceedings. Within the legislative branch, it applies to administrative matters such as procurement, as well as to “any investigations and reviews, conducted pursuant to the authority of any committee, subcommittee, commission, or office of the Congress consistent with applicable rules of the House or Senate.”

In outline form, Section 1001(a) states:

V. a. falsifies, conceals, or covers up by any trick, scheme, or device a material fact;b. makes any materially false, fictitious, or fraudulent statement or representation; orc. makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry; shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both. If the matter relates to an offense under chapter 109A [sexual abuse], 109B [sex offender registration], 110 [sexual exploitation], or 117 [transportation for illicit sexual purposes], or section 1591 [sex trafficking], then the term of imprisonment imposed under this section shall be not more than 8 years […]

Under Oath or Its Equivalent: Court or Grand Jury

Section 1623 reaches both false statements under oath and those offered “under penalty of perjury” by operation of 28 U.S.C. § 1746.84 The allegedly perjurious statement must be presented in a “proceeding before or ancillary to any court or grand jury of the United States.” An interview in an attorney’s office in preparation for a judicial hearing cannot be considered such an ancillary proceeding, but the phrase “proceedings ancillary to” court or grand jury proceedings does cover proceedings to take depositions in connection with civil litigation, as well as a variety of proceedings in criminal cases,88 including habeas proceedings, bail hearings, venue hearings, supervised release revocation hearings, and suppression hearings.

False or Inconsistent

The Supreme Court’s observation that a statement that is misleading but literally true cannot support a conviction under Section 1621 because it is not false applies with equal force to perjury under Section 1623. Similarly, perjury cannot be the product of confusion, mistake, or faulty memory, but must be a statement that the defendant knows is false, although this requirement may be satisfied with evidence that the defendant was deliberately ignorant or willfully blind to the fact that the statement was false. On the other hand, “[a] question that is truly ambiguous or which affirmatively misleads the testifier can never provide a basis for a finding of perjury, as it could never be said that one intended to answer such a question untruthfully.” Yet ambiguity will be of no avail if the defendant understands the question and answers falsely nevertheless.

Subsection 1623(c) permits a perjury conviction simply on the basis of two necessarily inconsistent material declarations rather than a showing that one of the two statements is false. Conviction does require a showing, however, that the two statements were made under oath; it is not enough to show that one was made under oath and the other was made in the form of an affidavit signed under penalty of perjury. Moreover, the statements must be so inherently contradictory that one of them of necessity must be false.

Rape is having sex with a woman while she screams for help. No scream, no rape according to Deuteronomy 22:23-24. Ford says Kavanaugh held his hand over her mouth so did she scream for help when his hand was elsewhere? After all, it was in a bedroom of a house; surely, one of the other 4 teens could have heard him scream when she bit his hand. Did she bite his hand? Poke him in the eye? Women know instinctively how to protect their honor: screaming, shouting, slapping, spitting, slugging, and stabbing with a finger, pencil, or hat pin. Since she did not cry out or stab him, I will not believe her without a film of the event.

MAYBE IT IS TIME WOMEN STOOD UP AND DEMAND THEIR RIGHT TO CONTROL THEIR OWN BODY PLUS EQUALITY/FREEDOM, INSTEAD OF GIVING AWAY THEIR POWER, FREEDOM AND RIGHTS TO WHITE, RICH, OLD, SEXIST MEN THAT ABUSE OR RAPE WOMEN AT WILL

Conservatives know that they are in the minority, so they must rig, steal, conspire and cover up the fact that the US is a progressive/liberal socialist nation, and that fact must also be covered up and denied by a Conservative Supreme Court, which must be maintained by any tactic available, including unconstitutional, illegal ones.

Why do women keep voting in sexist misogynistic men who abuse, rape and assault them, while also taking away their rights, freedom and equality? 

Women are trained to be subservient to men by their fundamentalist evangelical religions, by sexist males in the family, and by sexist politicians, who are most often rich, white and entitled. 

Women have a tendency to erase themselves and demean themselves as being unworthy or 'evil' or defective somehow.  

Women also have a tendency to think less of themselves than men, who are put on a pedestal. 

Men are served like a God by many women, while denying themselves of any rights, equality or freedom. 

Women tend to do whatever the man in their life orders them to do, including voting in racist, sexist men like Trump. Women often take a 'back seat' and allow rape, sexual assault, and men to walk all over them in general, well, just because the man might be upset if they object.

Beloved, now I share more with you about the freedom I desire you to manifest in your life. Of course, you’re aware that freedom may seem to be whisked away from under you. Whisked? More’s the pity as you seem to give your freedom boldly away. You seem to give away your life voluntarily without realizing it. You may come to to regret this, for you don’t always have the strength to follow through as the ultimate good guy.

Represent yourself. It isn’t selfish to know thyself. I say firmly once and for all that you are worthy. You are worthy. You are coming to grips with your worthiness now. Well done. You are moving forward. Be done with weighing matters that do not belong to you. Save yourself from drowning first.

Now you’re getting down to the truth at hand. No longer erase yourself in the slightest. Unless you have known your worthiness, you have been misinformed. You are worthy. There is no excess generosity you have to prove. There never was. Beloved, you are entitled to consider yourself as well as others. You don’t have to be good to excess. You are good enough.
