The Supreme Court is a court for the PEOPLE, for the US citizens of the USA, which is a free trade zone between dozens of independent states, tied together by the Constitution and the Bill Of Rights. This article is a story about how this court of, by and FOR the PEOPLE enforced the principle and American value of equality, on behalf of a tiny minority.
Despots, dictators, powerful religious leaders and kings often punish minorities and make minorities or poor people, or the homeless scapegoats in order to hold onto power and consolidate it even more to their own selfish greed/power, most often in the form of corporations. Despots and tyrants peddle fear plus hatred, against 'other' people who are different. Hitler peddled fear and hatred against gays, Jews, gypsies, and any other religion than the 'official' Nazi Fascist state approved one.
The problem with getting rid of minorities, punishing women, punishing other sexual orientations, getting rid of unions and letting corporations take over government is that the 99 percent lose everything, as the 1 percent/huge corporations take over everything.
Government and the courts are designed to balance this greed based selfish desire of the 1 percent who want everything their selfish way, while the 99 percent get nothing, but scraps. When people get desperate enough, violent revolutions are common. In Europe, before the EU, violent revolutions happened under despotic kings about every 50 years. Substitute corporations and CEO's for kings, and the same thing can happen in the US in the not too distant future.
The current battle happening in the USA is a battle between those who believe that all courts, all politicians, and all government agencies should serve and protect the PEOPLE, not the 1 percent and/or corporations. On the other side are the pro corporate minions who are ruled by greed, and who want to reshape the courts, politicians and government agencies to benefit themselves only, privatize everything and make GREED plus PROFIT for CORPORATIONS the law of the land, while leaving the PEOPLE (the 99 percent) out in the cold.
HOW LONG CAN AN UNCONSTITUTIONAL LAW STAY ON THE BOOKS AND BE ENFORCED IN THE USA?
It is POSSIBLE for people in the USA to pass laws about things that are not Constitutional, like making slavery legal, or taking away human rights, denying voting rights or eliminating the right to the pursuit of happiness. But how long will laws like this stay on the books when they violate the US Bill of Rights or the US Constitution? How long will US citizens stand for remaking the US government into something that serves only the 1 percent and/or corporations, but not 99 percent of people of the USA?
It was not too long ago, that California voters passed a law that said they could sell their homes to only white buyers and refuse to sell to black buyers. The Supreme Court struck down that majority vote of the people, because it was against the Constitution and Bill of Rights, that all men and women are created EQUAL, with an equal right to the pursuit of HAPPINESS.
True US citizens that believe in true American values, honor the Constitution do not want to do away with the US Bill of Rights. So how did 41 states prohibit interracial marriages by law as little as 45 years ago? The Supreme Court struck down this state law as well, as being unconstitutional (and UnAmerican).
14th AMENDMENT OF THE CONSTITUTION REQUIRES EQUALITY FOR ALL US CITIZENS
The Supreme Court has affirmed the right to marry 14 times. Part of American values is that true Americans do not allow inequality, and follow what is written and promised in the Constitution. The 14th Amendment requires equality for all US citizens.

Wallace asked Olson to identify the right to same-sex marriage in the constitution and wondered why "seven million Californians" "don't get to say that marriage is between a man and a woman."

VOTERS DO NOT HAVE THE RIGHT TO OVERTURN OR VIOLATE THE CONSTITUTION, UNLESS THEY CHANGE THE CONSTITUTION FIRST, WITH A CONSTITUTIONAL CONVENTION AND ALL STATES VOTING ON AN AMENDMENT
He stressed that under our system of government, voters can't deprive minority groups of their constitutionally guaranteed protections and reminded Wallace that in the 1960s, "Californians voted to change their constitution to say that you could discriminate on the basis of race in the sale of your home; the United States Supreme Court struck that down."
When Wallace pressed the point further, likening same-sex marriage to abortion and noting that "the political process in the case of same-sex marriage was working" since states had been deciding the issue on a "state-by-state basis," Olson asked Wallace how he would like it if Fox News' right to free speech was decided in such a manner:
OLSON: Well, would you like your right to free speech? Would you like Fox's right to free press put up to a vote and say well, if five states approved it, let's wait till the other 45 states do? These are fundamental constitutional rights.
The Bill of Rights guarantees Fox News and you, Chris Wallace, the right to speak. It's in the constitution. And the Supreme Court has repeatedly held that the denial of our citizens of the equal rights to equal access to justice under the law, is a violation of our fundamental rights. Yes, it's encouraging that many states are moving towards equality on the basis of sexual orientation, and I'm very, very pleased about that. ... We can't wait for the voters to decide that that immeasurable harm, that is unconstitutional, must be eliminated.
At the end of the interview, Wallace conceded that his right-wing points failed to crack Olson's arguments. "Mr. Olson, we want to thank you so much for joining us today. We'll keep following your lawsuit. And I gotta say, after your appearance today, I don't understand how you ever lost a case in the supreme court, sir," he said." When citizens pass state laws that make second class citizens out of some of their neighbors, family members and community residents, it is fundamentally discriminating against a minority. A law that prevents some citizens from pursuit of their happiness in a state of marriage is flawed.
We cannot deny the right to happiness of a few citizens who are living in our melting pot of many beliefs, many religions, many sexual orientations.
CHURCHES CAN AND DO DENY MARRIAGE CEREMONIES OR OFFICIAL STAMP OF APPROVAL TO MEMBERS OF THEIR CHURCH, SO THERE IS NO NEED TO MAKE SAME SEX MARRIAGE ILLEGAL FOR EVERYONE
There is no rationale basis for this anti-gay discrimination, just because it is a minority. Churches can and do have the freedom to deny marriage at any time and for ANY reason, to any members of their church. There is no need to pass a law that makes all gays 'illegal'.

Isn't it odd that is legal to be a gay soldier, fight and die for the USA, but it is 'illegal' for this same soldier to marry the gay man (or gay woman) that he/she loves?
Bottom line, there is an evolution in this country on many fronts. Many times, we take one step back, and do all of the wrong things first, before we move two steps forward and do it right.

The U.S. Supreme Court ruled 5-4 on Friday that it is legal for all Americans, no matter their gender or sexual orientation, to marry the people they love. The decision is a historic victory for gay rights activists who have fought for years in the lower courts. Thirty-seven states and the District of Columbia already recognize marriage equality. The remaining 13 states ban these unions, even as public support has reached record levels nationwide.
JON STEWART CALLS OUT JUSTICE SCALIA FOR VOTING AGAINST THE MAJORITY WILL OF THE PEOPLE, MOST OF THE TIME
DAILYKOS: Jon Stewart pointed out that while Justice Scalia implied that the Supreme Court should not overturn the will of the voters, he had no problem doing that with his Obamacare vote inasmuch as most people do not want it overturned. Stewart also reminded us that while Americans overwhelmingly want money out of politics, Scalia had no problem going against the people in the Citizens United case or the McCutcheon case. Groups like Move to Amend and Coffee Party USA are building grassroots movements that are fighting to mitigate this atrocity.
Justice Scalia had no problem destroying parts of the Voting Rights Act which most Americans support. He even implied that it was the court's job to go against the people as politicians would not on certain issues. He also had no problem appointing George W. Bush president of the United States even though he lost the election. The disaster that was the Bush presidency with the loss of life and treasure he effected on the country is the direct result of the actions of conservatives on the Supreme Court.
Antonin Scalia's pomposity is just that. It is the utterances of a dishonest ideologue. This man is the guardian of the American plutocracy and a clear and present danger to the country based on many of his decisions.

SUMMARY
Richard Valasek The top picture is the 2009 Obama inauguration. The bottom is yesterday's inauguration. I want to post this not as any kind of a gloat but to all who are feeling weak and marginalized now (and election results and all current popularity polls say this is the majority) can see a picture that can give a sense of the potential mightiness of those whose core values tell us "there is something wrong with this man."
A large majority of people are sensing this, even many who essentially support him. There are values that we all share, whether conservative or progressive, Democrat or Republican and we are feeling, all along the spectrum, something rubbing against the grain of these values. There is pain being felt through swaths our country and this needs to be recognized and addressed.
The greatest pain is from the social fracturing. There are forces driving wedges. Who is wielding the hammer and placing the chisel? Claims and speculations can be made. The world is a very different world from yesterday and the arrow of time does not flow backwards. If we now essentially ignore Trump and put our attention to reuniting, healing fractures, it may become irrelevant who is wielding the hammer, it simply will be no longer effective. Remember, each one of us is multiple, we are each many things. There are more parts of us that unite than there are parts that divide. And I think there are far more of us want to unite than to divide."
Selfishness, Fear and Hatred divides, while focusing on all of us, with love and peace plus what is good for all of US, rather than just ME, unites.
